Terms of Service

Welcome to Vetiver Labs ("Vetiver Labs", "we", "us", or "our"). These Terms of Service ("Terms") govern your access to and use of our website, AI image-generation tools, and related services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility & Age Requirement

The Service contains and produces sexually explicit, AI-generated adult content. You must be at least 18 years old, or the age of legal majority in your jurisdiction (whichever is higher), to access or use the Service. By using the Service, you represent and warrant that you meet this requirement and that accessing adult content is lawful where you live. Every visitor must confirm they are an adult at our age gate before seeing any content. Giving false information about your age is a serious breach of these Terms, and we will close any account we have reason to believe belongs to someone under 18.

2. Description of the Service

Vetiver Labs provides tools to generate images from text prompts using AI models. All images are synthetically generated and do not depict real, identifiable individuals unless you unlawfully attempt to make them do so, which is prohibited (see our Content Policy).

Fictional content. Every person shown on the Service is a fictional character created by AI. Any resemblance to a real person, living or dead, is coincidental, and deliberately making an image resemble a real person is not allowed. All characters are intended to be, and must be depicted as, adults aged 18 or older.

18 U.S.C. 2257 exemption. No real people are photographed, filmed or otherwise recorded to create any content on the Service. Every image is generated entirely by computer from text prompts, so the record-keeping requirements of 18 U.S.C. 2257 and 2257A and 28 C.F.R. Part 75, which apply to depictions of actual human beings, do not apply to it.

3. Accounts

You may sign in using third-party providers (such as Google or Fanvue). You are responsible for all activity that occurs under your account and for maintaining the security of your login. You agree to provide accurate information and to notify us of any unauthorized use.

• One account per person. Creating extra accounts to collect additional free tokens, get around limits, or return after a ban is not allowed, and we may close or merge accounts we believe are being used this way.
• Your account is personal. You may not share, sell, rent, lend or transfer it, or sell access to the Service through it.

4. Acceptable Use

Your use of the Service is subject to our Content & Acceptable Use Policy, which is incorporated into these Terms by reference. In particular, and without limitation, you may not use the Service to create, request, or distribute any content depicting minors or any other content prohibited by that policy or by applicable law. Violations may result in immediate termination and, where required, reporting to law enforcement.

5. Generated Content & License

Subject to your compliance with these Terms and applicable law, you retain rights to the images you generate, to the extent such rights are available under law. You are solely responsible for your prompts and for how you use generated content. You grant us a limited license to process, store, and transmit your prompts and generated content as necessary to operate and improve the Service (for example, to deliver images to your connected accounts).

Pro subscribers may choose to share individual images to the community feed, where every signed-in user can see them. Posts are shown without your name or email. The feed also includes images Vetiver Labs generates itself from prompts previously used on the Service, which are shown the same way. Sharing grants us a non-exclusive license to display that image on the Service for as long as it is shared. If you allow remixing, other Pro users can also see the prompt and settings used and generate their own images from them. Shared images must follow our Content Policy; we automatically screen them, may hold them for review, and may remove any post at our discretion. You can remove your post from the feed at any time.

6. Subscriptions & Payments

Premium access ("Pro") is provided through subscriptions managed by third-party platforms such as Fanvue. All payments, billing, renewals, and cancellations are handled by those platforms under their own terms. We do not process or store your payment-card details. Pro access is contingent on an active qualifying subscription and may be revoked when that subscription ends.

Pro can also be bought as a prepaid pass with cryptocurrency through NOWPayments. A pass gives Pro for the number of days shown at checkout, starting when the payment network confirms it, or when your current Pro time ends if you already have Pro. Passes do not renew automatically.

Token packs are available to active Pro subscribers and can be purchased with Telegram Stars or with cryptocurrency through NOWPayments. Tokens have no cash value, do not expire, and are usable only on this Service. Cryptocurrency payments are credited once the payment network confirms them, and an underpayment is not credited automatically; contact us with your order details to resolve it. Refunds of unspent tokens may be requested within 14 days of purchase. Because cryptocurrency transfers cannot be reversed, an approved crypto refund is paid back in cryptocurrency, to a wallet address you provide, less network fees.

We may offer a referral program that credits extra tokens if you share a personal link (for example on Reddit) and someone signs up from it, or if that person later buys Pro. Referral tokens have no cash value, can be changed or withdrawn, and may be refused if we think the activity is spam, self-referral, or against a third-party site's rules. You are responsible for following Reddit's and each subreddit's rules when you post. We do not post on your behalf.

7. Free Tier & Limits

We may offer limited free usage, such as a monthly token allowance restricted to selected models and default settings, which we may change at any time. Unused monthly tokens do not carry over. Tokens you have purchased remain in your account if your subscription ends, but models and styles included only with Pro are no longer available to you. We may also impose rate limits and concurrency limits to protect the Service.

8. Intellectual Property

The Service, including its software, design, and branding, is owned by Vetiver Labs and protected by intellectual-property laws. You may not copy, reverse engineer, or create derivative works of the Service except as permitted by law.

9. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that generated content will meet your expectations. AI output is unpredictable, and an image may not match your prompt.

We may add, change or remove features, models, styles and prices at any time. Changes to prices do not affect tokens or Pro time you have already bought. The Service may link to other websites and services, such as Fanvue, Telegram or NOWPayments; we do not control them and are not responsible for them, and your use of them is governed by their own terms.

10. Limitation of Liability

To the maximum extent permitted by law, Vetiver Labs shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or data, arising from your use of the Service. Our total liability for any claim shall not exceed the amount you paid (if any) in the twelve months preceding the claim. We are not responsible for delays or failures caused by events beyond our reasonable control, such as outages at our hosting, GPU or payment providers, internet failures, or actions by governments or platforms we depend on.

11. Indemnification

You agree to indemnify and hold harmless Vetiver Labs from any claims, damages, or expenses arising out of your use of the Service, your content, or your violation of these Terms or applicable law.

12. Termination

We may suspend or terminate your access at any time, with or without notice, for any reason, including violation of these Terms or our Content Policy. You can stop using the Service at any time, and delete your account from your account page, as described in our Privacy Policy. Deleting your account ends any unused tokens and Pro time, and does not cancel a subscription managed by Fanvue. If you think we closed your account by mistake, you can ask us to review it under our Complaints policy.

13. Changes to These Terms

We may update these Terms from time to time. Material changes will be reflected by updating the "Last updated" date. Continued use of the Service after changes constitutes acceptance.

14. Complaints & Disputes

If something goes wrong, please contact us first so we can try to put it right. Our Complaints & Content Removal policy explains how to raise a complaint, report content, send a copyright notice, or ask us to review a moderation or account decision, and how quickly we respond.

15. Governing Law

These Terms are governed by the laws of the place where Vetiver Labs is established, without regard to conflict-of-law principles. If you use the Service as a consumer, nothing in these Terms takes away any protection you have under the mandatory consumer laws of the country where you live, including any right to bring a claim in your local courts.

16. General

If any part of these Terms is found unenforceable, the rest remains in effect. Our not enforcing a provision is not a waiver of it. These Terms, together with our Privacy Policy, Content Policy and Complaints & Content Removal policy, are the entire agreement between you and us about the Service. You may not transfer your account or these Terms to anyone else. We may transfer the Service and these Terms to another business, for example if Vetiver Labs is sold or reorganized; your rights under these Terms, including tokens and Pro time you have paid for, continue with it.
